Résumé
Alors que l’OCDE appelle à développer les initiatives innovantes pour faire face aux échecs du « corporate governance », une loi belge du 6 avril 2010 témoigne d’une position proactive et met en oeuvre les propositions faites au niveau européen. D’un côté, certaines modifications législatives sont connues du juriste français et soulèvent des interrogations similaires à celles existantes en France. D’un autre côté, un certain nombre d’options choisies par le gouvernement belge présente un caractère original.
Abstract
While the OECD calls to develop initiatives to face the failures of the corporate governance, a Belgian law of April 6th, 2010 shows of a proactive position and implements the propositions made for the European level. On one side, legal modifications are known of the French jurist and pose similar interrogations to those existing in France. On the other hand, number of options chosen by the Belgian government presents an original character.
